While private capital gains are always subject to taxation, profits from disposals of private real estate and other private assets are generally tax-exempt. Further, according to the thesis, the exception of the general tax exemption is incompatible with the German Constitution. In conclusion, the thesis proposes a reform for a more consistent approach to the taxation of private asset gains.
