The thesis analyses the mandatory participation of physicians in medical standby duty in Germany in terms of constitutional law with a focus on the standby duty statutes of the medical associations »Ärztekammern« and »Kassenärztliche Vereinigungen«. While a mandatory participation itself is not a subject to constitutional-law doubts, its present legal implementation faces various issues. Therefore the thesis concludes with alternative legislative drafts aimed at solving the aforementioned problems.
